Director Food supplies caught on wrong foot! Violates Court Orders

Despite explanation, places storekeepers, head Clarks as interim TSO

Srinagar, Jun 14 (RNA): Despite a clear cut ban on posting Tehsil Supply officers on interim arrangements by Jammu and Kashmir Court, Director Food and public distribution FCS&CADK has placed many storekeepers and even head Clarks as interim TSOs.

“ In the meantime, subject to objections from the other side and toil next date of hearing before the bench , no interim arrangement shall be made against the post of Tehsil Supply officer ( TSO) and the post shall be filled up after finalization of Draft Recruitment Rules.” Reads the Stay order by Jammu and Kashmir High Court in a case titled Utta Mohammad Rather & others Vs State of Jammu and Kashmir.  Dated 13-11-2018.

However, despite the clear cut directions, the Director went ahead and posted an official as I/C TSO, Tral Godowns.

“You are directed to utilize the services of Mr. Hilal Ahmad Shah R.No. 4046 as I/C TSO Tral Godowns.” reads the order issued by Director Food supplies vide No. DFCS&CADK/ Admp-x-43/TSO dated 20-05-2019

However, this order did not go well with the court which served a strong explanation to the director asking him how Mr. Shah was posted as TSO despite stay.  The court also directed Director to appear in person to explain how the court orders were violated.

This is not all, the director did not stop even here. Instead went on to issue more such order though with a very twisted terminology and selective use of words.

“Mr. Nazir Ahmad Mir, storekeeper R.No Mir, storekeeper R.NO1 shall look after watrigam circle presently vacant.” Reads the order issued by Director Vide No. DFCS&CADK/ Adm/B-X-43/Bla dated 13-06-2019, a copy of which lies with RNA.

The Joint Director Administration Nazir Ahmad Mir however, defended the ‘ interim arrangements’ and said that he didn’t think there was any violation of Court orders. He however, admitted that the stay has not been vacated as yet, but added that many TSO’s were attaining superannuation and the large number of posts cannot be left vacant.

“ I don’t think these look after arrangements are in any way a violation of Court Order. We have scores of Circles without TSOs and this kind of arrangements is inevitable.” Mr. Mir told RNA, adding that the persons who have been given ‘look after’ charge are senor most and otherwise also eligible for promotion to TSO post. He also added that they don’t get any monitory benefits from this.

Director Food supplies Mohammad Qasim Wani however, said that he has explained to the court about his problems for not having the TSO after which the contempt notice was withdrawn and he was allowed to make alternate arrangements which did not include making any In -charge TSO.

“I explained to Honorable court about my problems for not having TSOs. That is  why, the contempt notice was withdrawn and I was allowed to make arrangements temporary. These are senior most that we give the additional charge.” Mr. Wani told RNA, adding that he is hopefully that the stay would get vacated during ext hearing on 2nd July.
